2. User Accounts and Registration

2.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account

2.2 Account Security

You are solely responsible for maintaining the confidentiality of your account password and your API key, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2.3 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Impersonate any person or entity or falsely state or misrepresent your affiliation
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Upload malicious code, viruses, or harmful content

3. User-Generated Content Ownership

3.1 Your Content, Your Ownership

You retain full ownership rights to all content you create, upload, or post on the Service ("User Content"), including but not limited to:

• Profile information, descriptions, and biographical data
• Images, photos, and media files
• Work experience, education, and project descriptions
• Links, integrations, and external data connections
• Any other text, data, or materials you provide

You own your User Content. We do not claim ownership of your User Content.

3.2 License to Use Your Content

By posting User Content on the Service, you grant EngineerProfiles.com a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:

• Use, reproduce, distribute, prepare derivative works of, display, and perform your User Content solely for the purpose of operating, providing, and improving the Service
• Make your public profile available to other users and visitors of the Service
• Store, cache, and transmit your User Content as necessary to provide the Service

This license continues even if you stop using the Service, until you delete your User Content or account (as described in Section 8).

3.3 Content Standards

You represent and warrant that:

• You own or have the necessary rights to all User Content you post
• Your User Content does not infringe on any third party's intellectual property, privacy, or other rights
• Your User Content does not contain defamatory, libelous, or unlawful material
• Your User Content complies with all applicable laws and regulations

3.4 Content Moderation

We reserve the right, but not the obligation, to:

• Review, monitor, or remove any User Content at any time
• Remove content that violates these Terms or is otherwise objectionable
• Suspend or terminate accounts that repeatedly violate these Terms

4. Profile Data Usage and Sharing

4.1 How We Use Your Profile Data

We use your profile data to:

• Provide, maintain, and improve the Service
• Display your public profile to visitors and other users
• Enable features such as profile sharing, integrations, and connections
• Send you service-related communications (account updates, security alerts)
• Analyze usage patterns to improve the Service (in aggregated, anonymized form)
• Comply with legal obligations and enforce our Terms

4.2 Public Profile Information

When you create a profile, certain information may be publicly visible, including:

• Your profile name, bio, and description
• Work experience, education, and skills
• Public images and media you upload
• Links and integrations you choose to display
• Any other information you mark as public

You control what information is public through your account settings. Private information (email, payment details, etc.) is never made public.

4.3 Data Sharing with Third Parties

We may share your data in the following circumstances:

Service Providers: We may share data with third-party service providers who perform services on our behalf (hosting, payment processing, analytics). These providers are contractually obligated to protect your data and use it only for the purposes we specify.

Integrations: If you connect external services (GitHub, Stackoverflow, etc.), we may share necessary data with those services to enable the integration. You control which integrations you enable.

Legal Requirements: We may disclose data if required by law, court order, or government regulation, or to protect our rights, property, or safety, or that of our users.

Business Transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred as part of that transaction. We will notify you of any such change in ownership.

With Your Consent: We may share data in other ways with your explicit consent.

4.4 Data Aggregation and Analytics

We may use aggregated, anonymized data (that cannot identify you) for analytics, research, and improving our services. This aggregated data is not considered personal information.

5. Data Portability

5.1 Your Right to Access and Export

You have the right to access and receive a copy of all personal data we hold about you. You can:

• View your data through your account dashboard
• Request a complete export of your data in a machine-readable format (JSON, CSV, etc.)

5.2 Data Export Process

To request a data export:

1. Contact us at contact@engineerprofiles.com or through your account settings
2. Specify the format you prefer (JSON, CSV, etc.)
3. We will provide your data export within 30 days of your request

Your data export will include:

• All profile information and User Content
• Account settings and preferences
• Integration connections and data
• Usage history and activity logs (if applicable)
• Any other personal data associated with your account

5.3 Data Format

We will provide your data in a standard, machine-readable format that allows you to:

• Transfer your data to another service
• Maintain a backup of your information
• Understand how your data is structured

6. Account Deletion and Data Retention

6.1 Your Right to Delete

You may delete your account at any time through your account settings or by contacting us at contact@engineerprofiles.com.

6.2 What Happens When You Delete Your Account

Upon account deletion:

• Immediate Deletion: Your account will be deactivated immediately, and you will no longer be able to access the Service
• Public Profile Removal: Your public profile will be removed from the Service within 24-48 hours
• User Content Deletion: All User Content you created will be deleted from our active systems within 30 days
• Data Export: We recommend exporting your data before deletion (see Section 5)

6.3 Data Retention After Deletion

After you delete your account, we may retain certain information for:

• Legal Compliance: As required by law, court order, or to resolve disputes
• Security and Fraud Prevention: To prevent fraud, abuse, or security issues
• Backup Systems: Data may exist in backup systems for up to 90 days before permanent deletion
• Aggregated Data: Anonymized, aggregated data that cannot identify you may be retained indefinitely

6.4 Content Shared by Others

If you have shared content with other users or if your content has been referenced by others, we may retain minimal information necessary to maintain the integrity of those connections, but your personal identifying information will be removed.

7. Payment Terms (If Applicable)

7.1 Subscription Fees

If you purchase a subscription or premium features:

• Fees are charged in advance on a recurring basis (monthly or annually)
• All fees are non-refundable except as required by law
• We reserve the right to change our pricing with 30 days' notice

7.2 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until the end of the period you've paid for.

7.3 Refunds

Refunds are provided only as required by law or at our sole discretion. If you believe you are entitled to a refund, contact us at contact@engineerprofiles.com.

8. Service Availability and Modifications

8.1 Service Availability

We strive to provide reliable service but do not guarantee:

• Uninterrupted or error-free operation
• That the Service will meet your specific requirements
• That defects will be corrected

8.2 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Change features, functionality, or pricing
• Perform maintenance that may temporarily interrupt service

We will provide reasonable notice of significant changes when possible.

9. Intellectual Property

9.1 Our Intellectual Property

The Service, including its design, features, functionality, and content (excluding User Content), is owned by EngineerProfiles.com and protected by copyright, trademark, and other intellectual property laws.

9.2 Trademarks

"EngineerProfiles.com" and related logos are trademarks of EngineerProfiles.com. You may not use our trademarks without our prior written permission.

10. Limitation of Liability

10.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENGINEERPROFILES.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10.3 Indemnification

You agree to indemnify and hold harmless EngineerProfiles.com, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

11. Termination

11.1 Termination by You

You may stop using the Service and delete your account at any time (see Section 6).

11.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent, abusive, or illegal activity
• You fail to pay required fees (if applicable)
• We discontinue the Service

11.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and User Content (subject to Section 6)
• Provisions that by their nature should survive termination will remain in effect

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by the laws of Utah, without regard to conflict of law principles.

12.2 Dispute Resolution Process

For any disputes arising from these Terms or the Service:

1. Informal Resolution: Contact us first to attempt to resolve the dispute informally
2. Mediation: If informal resolution fails, disputes may be resolved through binding mediation
3. Arbitration: Any disputes not resolved through mediation shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association ("AAA"), and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall be conducted in Salt Lake County, Utah.

12.3 Class Action Waiver

You agree that disputes will be resolved individually and waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

14. Changes to Terms

14.1 Modifications

We reserve the right to modify these Terms at any time. We will:

• Post the updated Terms on this page
• Update the "Last Updated" date
• Notify you of material changes via email or through the Service

14.2 Continued Use

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EngineerProfiles.com regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

16. Special Provisions for International Users

16.1 GDPR Rights (EU Users)
